Noise Myth:

Acoustic Reports which show that average noise levels are within accepted tolerances prove that noise won't be a problem from a new development .

 

Fact:

Not at all! There are a number of standards used for assessing machinery and commercial noise, but there is no fixed standard for assessing common law nuisance or amenity. It is a test of reasonableness and includes issues of undue disturbance or intrusion from noise and loss of peace and quiet.

Planning Applications

When considering a planning application, the Local Planning Authority has a statutory duty to have regard to the provisions of it's development plan and any other material considerations.
