Noise Myth:

My Council has handed me an Abatement Notice under Section 80 of the Environmental Protection Ac 1990, does that mean I will be prosecuted?

Not necessarily so! An Abatement Notice is usually served by a Council where it believes that a statutory nuisance exists or is likely to occur or recur. The notice will normally tell you what you must not do or tell you what positive steps to take to prevent a nuisance from recurring. If you are the recipient of an Abatement Notice, then don't panic our Noisedirect advisers can explain your right to an appeal and how to avoid any further action by your Council. All advice provided relates solely to professional matters in accordance with the statutory defined role of Environmental Health Practitioners, for the assessment of conditions that can give rise to nuisance or impact adversely on public health. Mistakes or Malice

Sometimes Councils can make procedural mistakes when taking enforcement action and on occasion can be over zealous. If you have been contacted by your Council and they have either issued you with an abatement notice or say that they will be taking formal action against you, then Noisedirect can explain statutory procedures and advise you how to take responsible measures to prevent legal action against you.

Often noise nuisance cases can escalate into more complex disputes of harassment with counter allegations from noise makers. Or sometimes unfounded allegations of anti-social behaviour or noise nuisance can be leveled at an innocent party, because of long running neighbour disputes. At Noisedirect we are expert at disentangling protracted disputes and can help provide independent assessments for nuisance cases and provide clear practical advice on how to deal with false or malicious allegations.

if you find you are the target of unfounded allegations then contact Noisedirect for clear confidential advice.
